Terms & Conditions
Last Updated: 3 June 2025 · Effective: 3 June 2025
These Terms and Conditions govern your use of the Pendulus website and the watch repair and restoration services we provide at 21 Beach Road, Nong Prue, Pattaya, Chonburi 20150, Thailand. By contacting us or submitting a watch for service, you agree to the terms set out below. Please read them carefully before proceeding.
If you have questions about these terms, write to us at [email protected].
1. Definitions
- Service — watch repair, servicing, restoration, and related work carried out by Pendulus.
- User / Client — any individual who accesses this website or submits a timepiece for service.
- We / Us / Our — Pendulus, operating at the address above.
- Agreement — these Terms and Conditions together with any written or verbal service quotation accepted by the Client.
- Timepiece — any watch, clock, or portable timekeeping instrument submitted for service.
2. Acceptance of Terms
By using this website or authorising a service, you confirm that you are at least 18 years of age, have the legal capacity to enter into an agreement, and accept these terms in full. If you are submitting a timepiece on behalf of a third party, you confirm you have authority to do so.
3. Service Description
Pendulus offers the following service tiers, with additional work available upon mutual agreement:
- Quartz Refresh & Reseal (฿3,500) — battery renewal, gasket check, water-resistance reseating, and external cleaning.
- Movement Service & Regulation (฿15,000) — mechanical movement cleaning, lubrication, and timing regulation with before-and-after readings.
- Full Heritage Overhaul (฿33,500) — complete movement renewal, case work, and resealing for older and sentimental timepieces, with full documentation.
Services are available to clients visiting our workshop in Pattaya or by prior arrangement. We reserve the right to decline a service request where a timepiece is in a condition that falls outside our current capabilities, and will communicate this clearly before any work begins.
4. Quotations and Pricing
Published prices are standard rates for the scope described. Where additional parts, complications, or condition issues require extra work, we will provide a written or emailed quotation before proceeding. No supplementary charges will be applied without your explicit approval.
All prices are stated in Thai Baht (฿) and are inclusive of labour unless otherwise noted. Parts, replacement crystals, or specialist components are billed separately at cost.
5. Client Responsibilities
When submitting a timepiece or using this website, you agree to:
- Provide accurate details about the watch's condition, history, and any known issues.
- Disclose if the watch has been previously repaired by another party, particularly if non-original parts have been fitted.
- Collect or arrange return of the completed timepiece within 30 days of notification. Uncollected watches held beyond 90 days may be subject to a storage fee.
- Use this website only for lawful purposes and not attempt to interfere with its operation.
6. Intellectual Property
All content on this website — including text, images, layout, and design — is the property of Pendulus or used with permission. You may view and print pages for personal, non-commercial reference only. Reproduction, redistribution, or modification of site content without our written consent is not permitted.
7. Payment Terms
Full payment is due upon collection or delivery of the completed watch. For Heritage Overhaul services, a 50% deposit may be requested at the point of authorisation. We accept cash (Thai Baht), bank transfer, and major credit cards. Payment confirms your acceptance of the work carried out.
Should you choose not to proceed after an initial assessment, a diagnostic fee may apply to cover the time spent evaluating your timepiece. This will be communicated before assessment begins.
8. Disclaimers
Our services are provided on a careful-workmanship basis. While we take every reasonable care, watchmaking involves inherent variables — particularly with aged, previously repaired, or heavily worn pieces. We do not represent that any service will restore a timepiece to factory specification or that all faults can be resolved within a single service.
Information on this website is provided for general guidance and does not constitute professional horological advice for any specific timepiece until an in-person assessment has been carried out.
9. Limitation of Liability
To the extent permitted by Thai law, our total liability in connection with any service or claim shall not exceed the amount paid by the Client for that specific service. We shall not be liable for indirect losses, consequential damages, loss of use, or sentimental value.
We are not liable for pre-existing faults that become apparent only after work begins, provided we notify you before continuing. Nor are we liable for parts or components that fail due to age or prior damage unrelated to the service performed.
10. Indemnification
You agree to indemnify Pendulus against any claims, losses, or costs arising from your breach of these terms, provision of inaccurate information, or unlawful use of this website.
11. Termination of Service
Either party may withdraw from a service agreement before work begins without penalty. Once a service is underway, the Client may request a stop at any stage; in this case, any work completed to that point will be charged at a pro-rated rate and the timepiece returned in its current state.
We reserve the right to decline or discontinue a service where safety concerns, missing authorisation, or circumstances outside our control make completion impractical.
12. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage Clients to contact us directly in the first instance so that we can work toward a fair and mutually agreeable resolution.
If informal resolution is not possible, disputes shall be subject to the jurisdiction of the competent courts of Chonburi Province, Thailand.
13. General Provisions
- Entire Agreement: These terms, together with any accepted quotation, constitute the full agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any term does not constitute a waiver of the right to enforce it later.
- Assignment: You may not assign your rights under these terms without our prior written consent.
14. Changes to These Terms
We may update these terms from time to time. When we do, the revised version will be published on this page with an updated effective date. Continued use of our website or services after such changes constitutes acceptance of the updated terms.
